1. Agreement to these terms
These Terms and Conditions (the "Terms") are an agreement between you and Rogue Treasure ("Rogue Treasure", "we", "us" or "our"), the maker of Num Null. Rogue Treasure is ROGUE TREASURE PRIVATE LIMITED, a private limited company incorporated in India (CIN U62011TS2026PTC224953), with its registered office at 8-1-284/OU/49, 1st Floor, OU Colony, Shaikpet, Golconda, Hyderabad, Telangana 500008, India. They apply to the Num Null game on Android, iOS and the web, the website at numnull.com, the web app at app.numnull.com, and any related features or updates (together, the "Game" or "Services").
By downloading, accessing or playing the Game, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Game.
2. Who can play
- You must be at least 13 years old (or the minimum age required in your country) to use the Game on your own.
- If you are under 18 (or the age of majority where you live), you may only use the Game with the permission and supervision of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use.
- You must not use the Game if you are barred from doing so under the laws that apply to you.
3. Your account
Ghost accounts
You can play as a Ghost using only a display name and country. A Ghost account is tied to the device and browser where it was created. If you log out, uninstall the app or clear your browser data, a Ghost account can't be recovered, and its progress, bits and power-ups will be lost.
Google accounts
If you choose "Continue with Google", your Num Null account is linked to your Google account so you can keep your progress across devices. You're responsible for keeping your Google account secure.
Your responsibilities
- Provide accurate information and keep it up to date.
- Keep your account to yourself. Don't sell, transfer or share it.
- You are responsible for all activity on your account. Tell us straight away at main@numnull.com if you think someone else has used it.
4. Your licence to play
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the Game for your own non-commercial entertainment on devices you own or control.
You may not, and may not help anyone else to:
- copy, modify, distribute, sell, rent or sublicense the Game or any part of it;
- reverse engineer, decompile or try to extract the source code, except where the law expressly allows it;
- use the Game, its boards, artwork or content to create a competing product, or for any commercial purpose without our written permission;
- remove or alter any copyright, trademark or other notices.
5. Virtual items
The Game includes virtual items such as bits (in-game coins), XP, and power-ups such as Undo and Flip ("Virtual Items"). You can earn them by playing, through daily rewards, and by exchanging bits in the in-game Store.
- Virtual Items are licensed to you, not sold. You don't own them, and they have no real-world monetary value.
- Virtual Items can't be exchanged for real money, goods or services, and can't be transferred, sold or traded with other players or outside the Game.
- Entry fees in bits are deducted when a game starts and are not returned if you leave a game early.
- We may change the value, price, availability or rewards of Virtual Items, or rebalance the in-game economy, at any time.
- Virtual Items are lost if your account is deleted, terminated or (for Ghost accounts) can't be recovered, and are not refundable except where the law requires.
If we offer real-money purchases in the future, they will be processed by the relevant app store or payment provider, and any additional purchase terms shown at the time will also apply. Nothing in these Terms affects your statutory rights as a consumer.
6. Fair play and conduct
We want Num Null to be fun and fair for everyone. You agree not to:
- cheat, including using bots, scripts, automation, modified clients, or tools that solve boards for you;
- exploit bugs or glitches to gain an advantage, or fail to report them when you find them;
- manipulate scores, matches, XP, rewards or leaderboards, including by creating multiple accounts, colluding with opponents or deliberately losing;
- interfere with, overload or disrupt the Game, our servers or networks, or try to access accounts or data that aren't yours;
- harass, threaten, impersonate or abuse other players, or use the Game for anything illegal or harmful.
If we believe you've broken these rules, we may remove scores, reset or remove Virtual Items, hide you from leaderboards, or suspend or terminate your account.
7. Display names and content
Your display name, avatar and country are shown to other players. Your display name must not:
- be offensive, hateful, sexual, violent, discriminatory or harassing;
- impersonate another person, brand or Num Null / Rogue Treasure staff;
- include personal information such as phone numbers or addresses, or advertising, links or spam;
- infringe anyone else's rights.
We may change or remove any display name that breaks these rules, without notice. You grant us a worldwide, royalty-free licence to display your display name, avatar, country, scores and results within the Game and on leaderboards for as long as your account exists.
8. Compete, XP and leaderboards
- In Compete mode you're matched with another player on the same board. If no opponent is available straight away, your run may be queued and matched later.
- Results, XP and rankings are calculated by our systems. We may review, correct or remove results that appear to be the result of errors, cheating or abuse.
- Leaderboards are provided for fun. Rankings carry no prize, reward or monetary value unless we expressly say otherwise for a specific event, in which case separate rules will apply.
9. Our intellectual property
The Game and everything in it — including the Num Null name, logo and icon, the gameplay design, boards, artwork, characters, sounds, music, text and software — are owned by Rogue Treasure or our licensors and are protected by copyright, trademark and other laws. Num Null™ and the Num Null logo are trademarks of Rogue Treasure Private Limited; applications to register them are pending. You may not use them, or anything confusingly similar, without our written permission, except to refer to the Game by name. Except for the licence in section 4, no rights are granted to you.
10. Feedback
We love hearing ideas. If you send us suggestions or feedback, you agree that we may use them freely to improve the Game, without any obligation or payment to you.
11. Third-party services
The Game relies on third-party services, such as Google for optional sign-in, hosting providers, and services that generate avatars and display flags. Your use of those services may also be governed by their own terms and privacy policies. We aren't responsible for third-party services, websites or content that we don't control, including sites you reach through links or sharing.
12. App store terms
If you download the Game from the Apple App Store or Google Play, you also agree to that store's terms of service. If there is a conflict about your use of the app, the store's usage rules apply where required.
If you use the iOS app: these Terms are between you and Rogue Treasure only, not Apple. Apple is not responsible for the Game or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the Game (including product liability, legal compliance or intellectual-property claims). To the extent permitted by law, Apple has no warranty obligation for the Game. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. Changes to the Game
We're always working on Num Null. We may update, change, suspend or discontinue any part of the Game, including features, modes, rules, Virtual Items and the in-game economy, at any time. Some updates may be required to keep playing. We'll try to give reasonable notice of major changes, but we can't promise the Game will always be available or free of errors.
14. Suspension and termination
You can stop using the Game at any time and ask us to delete your account by emailing main@numnull.com (see our Privacy Policy).
We may suspend or terminate your access, with or without notice, if you break these Terms, if we're required to by law, or if your use puts other players or the Services at risk. If your account is terminated, your licence ends and you lose access to your progress and Virtual Items. Sections that by their nature should survive termination (including sections 5, 9, 15, 16, 17 and 18) will continue to apply.
15. Disclaimers
The Game is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Game will be uninterrupted, secure, error-free or that data won't be lost. Some jurisdictions don't allow certain disclaimers, so some of these may not apply to you.
16. Limitation of liability
To the fullest extent permitted by law, Rogue Treasure and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, Virtual Items, profits or goodwill, arising from or related to your use of (or inability to use) the Game.
Our total liability for any claim relating to the Game is limited to the greater of (a) the amount you paid us, if anything, in the 12 months before the claim arose, or (b) INR 1,000 (or the equivalent in your local currency).
Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
17. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Rogue Treasure from any claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Game.
18. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Before starting any formal proceedings, please contact us at main@numnull.com so we can try to resolve the issue informally; most concerns can be sorted out quickly this way.
If a dispute can't be resolved informally within 30 days, it will be subject to the exclusive jurisdiction of the competent courts in India. If you are a consumer living in another country, you may also have the right to bring proceedings in your local courts and to benefit from mandatory consumer protections of your country, which these Terms do not override.
19. General
- Entire agreement: these Terms and our Privacy Policy are the whole agreement between you and us about the Game.
- Severability: if any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver: if we don't enforce a right straight away, we haven't given it up.
- Assignment: you may not transfer your rights under these Terms. We may transfer ours, for example as part of a merger or sale of the business.
- Events beyond our control: we aren't responsible for delays or failures caused by events outside our reasonable control.
20. Changes to these terms
We may update these Terms from time to time. We'll update the effective date above and, for significant changes, let you know in the Game or by other reasonable means before they take effect. If you keep playing after the changes take effect, you accept the updated Terms. If you don't agree, please stop using the Game.
